Please go through the Terms and Conditions that govern the further relationship between you (hereinafter referred to as "Client") and Cold Feet Adventure Nepal Trekking (P) Ltd. (hereinafter referred to as "The Company"), Company Registration Number: 60636/065/066. By booking any trip with us, you are agreeing to be bound by the Terms and Conditions of Cold Feet Adventure Nepal Trekking Pvt. Ltd. And by agreeing to sign this agreement and Terms and Conditions, both parties agree to resolve any legal or other disputes that may arise during the trip.
1. Booking Conditions
The "trip" refers to any activities or product itinerary that you buy with us including peak climbing, trekking, tours, expeditions, rafting, jungle safari, or other adventures in Nepal or other countries.
A booking is accepted and confirmed only from the date when The Company sends a confirmation email or invoice to the Client. This is where the contract between The Company and The Client comes into existence.
The Company reserves the right to increase the brochure prices before your booking is confirmed and the contract comes into existence. However, please note that the company would not be liable to any warrant, prior agreement, collateral agreement, and description of services or conditions other than expressed herein.
2. Deposit Requirements
The Clients are required to deposit or make full payment for the booking they have made as for the following terms and conditions:
i. The deposit will be 50% of the total trip price which is non-refundable.
ii. The remaining amount on the receipt must be paid within 3 full days following the trip departure
ii. All agreed upon amount must be paid fully by the Client; otherwise The Company has the authority to cancel the trip.
3. Payment Method
Currently, Cold Feet Adventure Nepal Trekking Pvt. Ltd. supports "Wire/Bank Transfer" as the payment mode. Note: We are not liable of any loss or delay during the wire transfer process. In case, if due the use of mediator bank services or any other reasons, the amount received by the Company is less than the amount sent by the Client, the Client is requested to pay accordingly so that the total amount is equivalent to the Trip Cost.
Please don't forget to email us the bank reference number or remittance slips after you initiate the transfer. It makes easy for us to check the money.
4. Cancellation Policy
4.1 Cancellation by the Client
If any Client wants to cancel the trip booked with us, the cancellation must be made in writing and acknowledged by the Company before 5 full days of the trip departure. Otherwise, 25% cancellation charge will hence be deducted from the deposited amount.
Please not that no refunds will be made if you voluntarily leave the trip for any reason after the trip has begun. There will be no refunds for any accommodation, transport, meals or services unused.
4.2 Cancellation by the Company
The Client should duly accept the following cancellation policies by the Company:
i. The Company reserves the right to cancel any arrangements without the prior notice, but the Client should be furnished with reasons at the earliest possible. In case the Client is affected with that decision, the full amount the Client has deposited will be refunded.
ii. The Company reserves the right to alter the program due to reasons beyond its control. The Company has to inform the Client about the change of itinerary or program in management's convenient time.
iii. The package cost does not include the cost of travel insurance, laundry, admission fees, and purely personal expenses.
5. Visa and Passport
The Client must carry the valid passport and have obtained the appropriate visas when traveling with Cold Feet Adventure Nepal Trekking. Please ensure whether or not your passport is valid six (6) months beyond the duration of the trip. For Nepal, the visa will be available on your arrival. In case of India, Tibet and Bhutan, the Company can make necessary arrangements upon request.
6. Medical Conditions
The Client must notify in writing at the time of booking of any medical conditions which may affect the fitness to travel. Otherwise, the Client can be refused to travel. In case the Client is failed to notify the Company of any such condition that results in cancellation and will result in 100% cancellation fees to the Client.
Some trips may not be suitable for Clients due to age, pregnancy or physical or mental conditions. So, it's the responsibility of the Client to check prior to book their trip. The Company is not required to provide any special facilities unless it has agreed to do so in writing.
As the medical facilities vary from country to country, our Company makes no representations and gives no warranties in connection with the standard of such treatment.
7. Travel Insurance
It is mandatory for all travelers to have valid travel insurance. The travel insurance must cover the personal liability, accidents, illness, injury, and death medical, expenses including any related pre-existing medical conditions, and emergency repatriation that covers the helicopter rescue and air ambulance where applicable. The Company however recommends to the Clients that their travel insurance also covers the trip cancellation or the loss of personal effects. While traveling to Nepal, you must carry proof of insurance with you and produce it if reasonably requested by the Company employees. Otherwise, the Company reserves the right to cancel or suspend Client's participation on trip or in certain other activities that comprise a part of trip at any time, with no refund.
8. Risk Factor and Liability
Risks of spending a vacation and/or involving in any adventure activities in Nepal under the management and operation of Cold Feet Adventure Nepal Trekking exists and applies, but not limited to, the following clauses:
i. Traveling by land, air or any forms of means of transportation.
ii. Trekking, rafting, climbing or doing any other adventure activity in any parts of Nepal.
iii. Any kind of natural and/or unnatural mishaps, accidents or illness during the entire duration of the itinerary.
iii. Any kind of obstruction or hassle including bandhs, strikes, wheel strikes in any part of Nepal affecting the tour program.
In any of these unintentional or uncalled for circumstances, I shall not hold Cold Feet liable to any penalty or damage of property, health or lives of anyone involved. The Client would not claim or blame for any action, demands, and debts arising out of or in cancellation with such trip organized by Cold Feet Adventure Nepal Trekking, its agents or associates.
9. Flight Delays and Itinerary Changes
Please note that mountain adventures are always unpredictable. Unfavorable weather conditions in high mountain regions can cause domestic flight delays in Nepal. If such is the case, Cold Feet Adventure team will meet the departing city accommodation (Guest House) and food (lunch and breakfast) cost prior to the departure date. But in case of delayed return flights, the Client should bear all additional expenses including the food and accommodation costs. And if the Client wishes to make an alternative arrangements such as Helicopter flight to avoid the flight delays, all additional cost would be the responsibility of the Client.
10. Injuries and Evacuation
Cold Feet Adventure Nepal Trekking Pvt. Ltd. would not be liable to any injuries or health conditions or other conditions suffered by the Client during the trip. Please note that our trip cost does not include any personal insurance. Therefore, we advise the Clients to take the adequate insurance packages that cover their medical emergencies and evacuation by the Helicopter.
11. Unused Services Policy
Cold Feet Adventure Nepal Trekking Pvt. Ltd. will provide no discounts and no monies will be refunded for unused or missed services. This includes the voluntary or involuntary termination or departure from trip due to late arrival, premature departure, sickness, death of family member etc.
12. Updates of Terms and Conditions
The Company reserves the right to update and amend the terms and conditions anytime without the prior notice to update it. It is the responsibility of the Client to keep updated with any changes.
